Affiliate program terms

POPGUNSERVERS AFFILIATE PROGRAM TERMS

Effective date: 2026-11-08
Version: 1.1

1. Organizer and participation

The program is operated by Open Makers, Stefana Drzewieckiego 9c/9, 80-464 Gdansk, Poland, tax identification number (NIP): 9570675395, referred to as “Popgunservers”.

The program is invite-only and available only to businesses approved by Popgunservers. Invitations are personal and cannot be transferred. Participation begins when you accept these terms, and Popgunservers activates your partner account.

You must provide accurate company, tax, and payment details and keep them up to date. Participation does not authorize you to represent Popgunservers, enter into agreements on its behalf, or make promises about its services.

2. Referral attribution

A new customer is a customer who has not previously held a Popgunservers account. Creating another account does not make an existing customer eligible.

To qualify, the customer must register through your referral link within the attribution window.

The attribution window begins when a new customer first clicks your valid referral link and lasts for 30 days.

The customer must both register and complete payment for their first eligible order within that same 30-day window. Registration does not restart or extend the window. This deadline applies only to the first eligible order; later eligible payments are governed by the 12-month commission period described in Section 3.

Attribution follows the first-click rule: the first valid referral link used within the attribution window determines the partner. Subsequent referral links do not overwrite an existing, unexpired attribution. Only one partner may receive commission for a customer.

Referral tracking uses a first-party attribution cookie. Blocking or deleting the cookie, using a different browser or device, or withholding consent where required may prevent attribution.

A referral qualifies only if it is successfully recorded and linked to the new customer’s account at registration. Untracked referrals cannot be added manually or claimed retroactively.

Once a referral has been linked to the customer’s account, deleting the cookie or changing browsers or devices does not remove that attribution. The original attribution deadline still applies to the first eligible order. Account attribution does not extend or restart the 12-month commission period.

Any referral discount, its duration, and its restrictions are shown in the customer’s offer or checkout. A discount does not itself guarantee eligibility for commission.

3. Eligible orders and commission

You earn commission on the first successful paid eligible order of each eligible referred customer and on subsequent eligible purchases, recurring payments, renewals, and add-on purchases during that customer’s 12-month commission period.

The commission period begins when payment for the customer’s first eligible order is received and confirmed, provided that the first-order attribution requirements in Section 2 are met. It lasts for 12 calendar months from that payment confirmation and expires at the corresponding date and time 12 months later. If the corresponding day does not exist in the final month, the period expires at the same time on the last day of that month.

A later payment earns commission only if it is received and confirmed before the commission period expires. Placing an order or starting a payment before expiry is not sufficient if payment is confirmed after expiry. Each payment is assessed separately, including recurring payments and renewals.

The commission period is fixed for each referred customer. Subsequent purchases, renewals, add-on purchases, or referral-link clicks do not restart or extend it. Payments confirmed at or after expiry do not earn commission. Expiry does not cancel commission already earned on eligible payments confirmed before expiry; that commission remains subject to the grace period, adjustment, and payout rules in these terms.

A successful paid order is an eligible order for which payment has been received and confirmed. Failed, unpaid, canceled, and fully refunded orders do not qualify.

Commission is earned only on eligible service orders, including renewals and add-on purchases, paid directly through a supported payment provider within the commission period.

Wallet top-ups, Paysafecard top-ups, and orders paid wholly or partly using wallet funds do not earn commission. Free orders and free trials do not earn commission.

The default commission rate is 10%, unless a different rate has been individually agreed with Popgunservers in writing. Your effective rate is shown in your partner panel.

Commission is calculated on the amount actually paid for the eligible order after discounts, excluding VAT and other sales taxes included in that amount. We convert this net amount to USD and multiply it by your effective commission rate.

The calculation uses the tax treatment applicable to the original transaction. Where the paid amount includes 23% VAT, the net amount is calculated by dividing the gross amount by 1.23. Transactions subject to a different tax rate, exemption, or reverse charge use their actual tax treatment.

The conversion uses NBP average exchange rates published on the date the customer is attributed to your partner account at registration. If no rates are published on that date, the latest rates published before that date apply. We record the applicable rates and use those same recorded rates to calculate commission on eligible payments throughout that customer’s 12-month commission period. Commission amounts are rounded to two decimal places.

The commission rate applicable when each eligible payment is confirmed is your effective rate at that time. Later rate changes do not alter commission already earned on that payment.

4. Pending commissions and adjustments

Commission remains pending for the grace period shown in your partner panel, counted separately from confirmation of each eligible payment. It becomes payable after that period ends, provided the order remains eligible.

Refunds, chargebacks, and lost payment disputes reduce or cancel commission. A partial refund reduces commission proportionally, using the original net commission calculation basis and recorded exchange rates.

Popgunservers may temporarily hold the affected commission while a payment dispute or suspected abuse is investigated. Popgunservers will notify you of the reason and the outcome, subject to legal and security restrictions.

If a commission has already been paid and is subsequently reduced or canceled, the resulting overpayment will be deducted from future payouts. Any required correction to the partner’s invoice and its VAT must be handled in accordance with applicable law.

If participation ends before Popgunservers has fully recovered the overpayment, Popgunservers will provide an itemized statement explaining the adjustments and any deductions already made. You must repay the remaining overpayment by bank transfer within 30 days of receiving the statement and payment request.

Adjustments and their reasons will be recorded in your partner account or communicated to you.

5. Payouts and invoices

We make payouts only to businesses against a valid invoice issued by the partner.

The minimum payout balance is USD 50 in approved net commissions after any deductions. Pending commissions and VAT applicable to the partner’s invoice do not count toward this threshold.

You may request a payout once the payable balance reaches this minimum.

Submit your payout request and upload your invoice as a PDF through the Affiliate Program section of your user panel.

Partners established in Poland must issue invoices through KSeF where required by Polish law and upload a PDF representation, including the KSeF invoice reference where applicable. Partners established outside Poland must submit only a PDF invoice.

The invoice must identify Open Makers, Stefana Drzewieckiego 9c/9, 80-464 Gdansk, Poland, NIP 9570675395, and the commission period being invoiced.

Popgunservers pays valid, undisputed invoices within 30 days of receiving a correct invoice, provided you meet the payout conditions. If an invoice requires correction, Popgunservers will explain what must be corrected. The payment period begins when we receive the corrected invoice.

Payouts are made in USD by bank transfer to the bank account specified on your invoice.

The commission shown in your partner panel is a net amount, exclusive of VAT applicable to your invoice. VAT charged on the customer’s order and VAT applicable to your invoice are separate tax matters.

Partners required to charge Polish VAT must add the legally applicable VAT to their invoice, currently 23% for affiliate services. Popgunservers pays that VAT in addition to the net commission. Partners legally exempt from VAT must not add VAT.

For services subject to reverse charge, the partner invoices only the net commission, without adding VAT. Open Makers accounts for the applicable Polish VAT separately; that VAT is not included in the payment to the partner.

Invoice VAT does not count toward commission balances or the minimum payout threshold of USD 50.

You are responsible for issuing your invoice with the correct tax treatment, meeting your own tax obligations, and providing accurate payment details.

6. Prohibited activity and promotion

Self-referrals, duplicate accounts, fabricated customers, fraudulent transactions, unauthorized incentivized sign-ups, and misleading promotion are prohibited.

Shared network access alone does not establish fraud. Popgunservers may consider shared account, payment, device, or network information together with other evidence when assessing eligibility.

You must clearly disclose the commercial nature of your referral promotion wherever required by applicable law or platform rules.

You must not impersonate Popgunservers, send unlawful or unsolicited promotional messages, make unsupported claims, or use Popgunservers branding in a way that suggests an official endorsement beyond your approved partner status.

Paid advertising is permitted, provided it complies with these terms and applicable platform rules.

Without prior written approval from Popgunservers, you must not bid on “Popgunservers” or confusingly similar brand terms in paid search advertising, or register or use domains that could be mistaken for an official Popgunservers website.

You may use promotional materials supplied or approved by Popgunservers, but must not alter them in a misleading way or present yourself as an official representative.

7. Changes to the program

Popgunservers may change commission rates, referral discounts, program parameters, and these terms for future eligible orders, subject to any binding individual agreement.

Material changes to these terms will be communicated by email to the address registered in your partner account at least 14 days before they take effect. The email will identify the effective date, list the changes compared with the previous version, and explain how to access the updated terms.

Changes required immediately by law or to address fraud or security risks may take effect without advance notice. Popgunservers will notify you by email without undue delay and explain the reason for the immediate change.

Changes do not retroactively reduce commission already earned.

8. Suspension and termination

You may leave the program by contacting Popgunservers through the official contact form on the Popgunservers landing page.

Popgunservers may suspend or terminate participation, including for breach of these terms, fraud, legal requirements, or closure of the program. Popgunservers will notify you and explain the reason, subject to legal and security restrictions.

Valid commission earned before termination remains subject to the grace period and adjustment rules.

After termination, the final payable balance may be paid against a valid invoice only if it reaches the minimum payout of USD 50 in approved net commissions after any deductions. Termination does not waive this threshold. A balance below the threshold is not payable unless otherwise individually agreed in writing.

Orders paid after participation has ended do not earn commission, even if the customer was attributed to you before termination and their 12-month commission period has not yet expired. Commission earned on eligible orders paid before termination remains payable under these terms.

9. Privacy and reporting

Your reports do not provide referred customers’ names, email addresses, billing details, or other directly identifying information.

Popgunservers processes referral, account, and transaction information as necessary to operate the program, calculate commissions, and prevent abuse, as described in its Privacy Policy.

Information that can still be linked to a customer is not treated as anonymous merely because direct identifiers are hidden. Tracking technologies and any required consent are governed by the applicable privacy and cookie notices.

10. Questions and disputes

Use the official contact form on the Popgunservers landing page for program questions, payout issues, commission disputes, or resignation notices.

A dispute should identify the relevant referral, transaction, or adjustment and explain the objection.

Popgunservers will respond within 14 days of receiving your message. If further investigation is needed, Popgunservers will provide an update within that period and an expected date for the final response.

11. Applicable terms and law

These terms govern participation in the affiliate program. Popgunservers’ general terms continue to govern use of its services. If they conflict on an affiliate-program matter, these program terms take precedence.

Any individually agreed commission rate takes precedence over the default rate specified in these terms.

Polish law governs the program. Disputes are subject to the court having territorial and subject-matter jurisdiction over the registered office of Open Makers, the operator of Popgunservers, without excluding rights or jurisdiction rules that cannot lawfully be waived.
